If companies like chemical manufacturer ChemChina become immune from a failure to warn, the liability shifts to the seller and the farmer. The innocent seller doctrine and indemnification for the seller from the manufacturer are moot—North Dakotans will pay the price for foreign company deception.
Please veto House Bill 1318 because it gives foreign chemical corporations like ChemChina totalimmunity for violating federal pesticide labeling requirements.
