HB385 has left the House Election Law Committee and is on its way to the House Floor on Wednesday, March 26th.

This bill would repeal the provisions in HB1569, passed in 2024. HB385 would reinstate the ability to register to vote by signing a sworn affidavit if the voter does not have physical proof of identity, age, citizenship, or domicile (address), or if they don’t have photo ID when they arrive at the polls to receive their ballot. Prior to HB1569 being passed, voters could sign a sworn affidavit under penalty of perjury if they were registering to vote but didn’t have all of the necessary documents.

This is important because many voters don’t have documents easily available and ready to bring with them to the polls – especially proof of citizenship, which can only be proven by providing a birth certificate, passport, or naturalization papers. Under this current law, eligible voters will be turned away from registering or voting solely because they lack the necessary documents.
