STOP H.R.7371 A Federal Transport Ban on Gamefowl

H.R. 7371 represents a troubling expansion of federal authority into lawful animal commerce under the guise of transportation policy.

While animal fighting is already illegal under federal and state law, this bill does not strengthen enforcement against illegal activity. Instead, it punishes lawful owners and breeders, many of whom ship birds for legitimate breeding programs, conservation efforts, and agricultural purposes, fully complying with all applicable state and federal laws and having no connection whatsoever to criminal conduct.

A categorical prohibition on airline transport of gamefowl would effectively cripple lawful interstate commerce without any individualized finding of wrongdoing while creating a dangerous precedent to restrict shipment of other species and animals.

If Congress can prohibit air transport of gamefowl, it logically follows that it could later prohibit certain dog breeds, certain livestock classes, reptiles, exotic birds bred for conservation, or even animals used in exhibition or agriculture. Once transportation access is restricted for one category of lawful animals, the same framework can easily be applied to others.

Importantly, H.R. 7371 could also be interpreted—or amended in the future—to prohibit the shipping of additional bird species or other animals entirely.

Today it is gamefowl; tomorrow it could be poultry breeds, parrots used in conservation programs, exhibition birds, or livestock essential to agricultural production. Transportation access is foundational to lawful commerce.

Removing that access sets a federal template that could be expanded well beyond its original scope, placing numerous animal-related industries at risk and normalizing policy decisions driven by ideology rather than evidence.
