I am writing to ask for your support for children’s services providers’ liability insurance affordability and availability issues that have put our network at risk of collapse (https://pccyfs.org/wp-content/uploads/2025/05/PCCYFS-Full-Insurance-Briefing-2025.pdf). During the 2021-2022 legislative session, the House unanimously passed HB2214, an important first step in addressing the looming insurance crisis by making void or unenforceable language in county contracts that seeks to shift all responsibility to the provider regardless of who is at fault. We believe that providers and counties should each own their own liability and are advocating for legislation that advances this position. This bill would limit the use of unfair unilateral waivers of subrogation in county contracts that limits a provider’s ability to portion responsibility to a county. We’ve heard from insurers that this language can be a cost driver because of the ways that providers are covering county decisions and is an important step in addressing the children’s services insurance crisis.
