<p><strong>What if CA could reduce distracted driving and encourage safer driving habits (less speeding and safer driving) by offering hundreds of dollars of discounts on car insurance to good drivers? </strong>Every other state, except CA, already does this. <p><strong>What is <a title="AB 311 Infographics" href="https://drive.google.com/file/d/15Zqj7EzO16jBDxinJti7widltqBD5tas/view?usp=sharing">Assembly Bill 311</a>?</strong></p>
<p>AB 311 by Asm. Tina McKinnor would provide a way for CA insurance companies to establish an opt-in "telematics" program under the oversight of the CA Dept of Insurance. Once established, California drivers could volunteer to download an app that would encourage safer driving and reward responsible behavior with large discounts on their insurance premiums. </p>

<p><strong>How Does "Telematics" Work?</strong> </p>
<p>Telematics are voluntary programs (never mandatory) that allow drivers to opt in to have their driving habits – speeding, breaking, acceleration, texting on one’s phone (but not what is being texted), etc., monitored by an app and given a score. If that score is high enough to show the driver is a low risk for a traffic collision, they are given a significant discount on their insurance. </p>
<p>Periodically, the driver is given a scorecard showing how safe their driving has been over the past several months, along with suggestions for safer driving. This scorecard helps the driver understand how they actually drive and provides ways to improve their score, making them a better driver. </p>
<p>This type of technology most commonly works through an app on your phone, but it can also work in other ways. </p>
<p>Many more modern cars, like Teslas, already use telematics to provide feedback on how safe a trip or a driver is, but in CA, unlike the rest of the US, you can’t get an insurance discount for a good score. </p>

<p><strong>Does Telematics Work to Save Lives on our Roads? </strong></p>
<p>ABSOLUTELY, YES! </p>
<p>A study published in the Journal of the American Medical Association found that telematics programs reduced handheld phone use by 14-21%</p>
<p>A separate study by the AAA Foundation found that telematics programs reduced speeding by 11–13% and reduced harsh braking and rapid acceleration (two factors that can cause a traffic collision) by 16–25%</p>
<p>The most dangerous drivers don't usually opt in to a telematics program because they know they aren't safe drivers and won't get a discount. Where telematics really helps are those drivers who think they are better and drive safer than they actually do (which is more than most of us realize). <strong>When they get the scorecard, it helps improve their driving habits, so they drive better and are less likely to be involved in a traffic collision. </strong></p>

<p><strong>How Much do People Save? </strong></p>
<p>In a survey conducted by Consumer Reports, the median annual savings from using telematics was $120. Those with younger drivers on their policy saved the most money on their annual premium—a median savings of $245. Younger drivers fared better in general; the median savings for drivers under 45 was $145. Median savings were $102 for the 45-59 age bracket, $115 for the 60-69 group, and $93 for those 70 and older. People with three or more drivers on their policy also fared slightly better. </p>
<p>CR’s survey also found that the median annual savings among Black ($186) and Latino ($174) policyholders were higher than the median savings for white ($98) and Asian ($109) policyholders after signing up for driver monitoring. </p>

<p><strong>What Privacy and Consumer Protection Safeguards does AB 311 Have?</strong></p>
<p>AB 311 has been designed with the strictest privacy and consumer protection safeguards of any program across the US. </p>
<ul>
<li>Any personal data collected to assess the driver's safety must remain confidential and may not be used for any other purpose or sold to a third party for any reason.</li>
</ul>
<ul>
<li>Any personal data gathered must be deleted within a short period of time and cannot be stored. That period depends on how often you get a scorecard, but it's usually every 3-6 months. <br /><br /></li>
<li>You can opt out of a telematics program, in which case your personal data must be deleted.</li>
</ul>
<ul>
<li>Once you download the app, personal data is not stored until you expressly allow it when signing up for a telematics program.</li>
</ul>
<ul>
<li>Your personal driving record and driving score, including how the score is determined, can be accessed for review. Any disagreements with the score or individual "driving incidents" that count against your score can be appealed. An appeal of a "driving incident" must be ruled in your favor since you were the driver present at the time. </li>
</ul>
<ul>
<li>Any telematics-based program would be administered under the oversight of the CA Dept of Insurance, which may impose even stricter standards to address evolving technology or new privacy issues, but they are not allowed to weaken the provisions of AB 311. </li>
