Support the Charitable Act (S.317/H.R. 801)

The non-itemizer charitable tax deduction, originally established under the CARES Act in 2020, allowed taxpayers who do not itemize their federal income taxes to deduct a portion of their charitable contributions. This provision expired at the end of 2021, despite data showing that charitable donations and donor participation increased while it was in effect.

In 2020 alone, 42.5 million households claimed the deduction, generating $10.9 billion in charitable giving nationwide. That year, overall charitable giving increased by 10.6%, and the number of donors rose by 7.3% compared to 2019. Since the deduction expired, small-dollar donations have declined significantly, and overall giving has dropped.

The Charitable Act (S.317/H.R. 801) would reinstate the non-itemizer charitable deduction, ensuring that all taxpayers—not just the wealthiest 10% who itemize—are incentivized to support charitable nonprofits in their communities.

Our state’s revenue system supports services, ranging from public education and public health to environmental protection, public safety and corrections, that are essential in the lives of all Marylanders. But this system, critical to the future of our people and our state, has become both inadequate to meet our needs and worse, unfair to those supporting it. The state budget faces a future of growing deficits, while for too long the poorest in our state have paid a higher burden in taxes than the wealthiest.
